These General Terms and Conditions and customer information apply to all contracts that you conclude with us, Dokudu UG, via our online shop at www.dokudu.com.
These General Terms and Conditions deem a consumer to be any natural person who completes a legal transaction for purposes that are for the most part not attributable to any professional activity of either a commercial or self-employed nature they engage in (as defined in § 13 BGB).
Neither the customer’s own terms and conditions nor any other terms and conditions that deviate from these General Terms and Conditions will be honored unless the seller expressly consents to the validity thereof.
- CONCLUSION OF CONTRACT
All product descriptions on the seller’s website such as images, color images, sizes and weights are approximate and not binding. Our offers are subject to change and are subject to availability. Small deviations and technical changes compared to our pictures or descriptions are possible, as far as this is reasonable for the customer.
The presentation of the articles is not a legally binding offer, but an invitation to you to submit a binding offer to us. You can submit this offer to us by inserting the desired items in the virtual shopping cart and sending the order with the items placed in the shopping cart (click on the “Place Order” button). By clicking the “Place Order” button, you confirm that you have read and accepted the Terms and Conditions. After we receive your order, you will automatically receive an e-mail documenting your offer (order). This email only confirms that we have received the order; a contract is not yet concluded. An effective contract is only concluded when we accept your offer within five days by requesting payment after placing the order, by confirming the order by email or by telephone or by delivering the goods.
A binding contract can also be concluded beforehand as follows:
If you have selected credit card payment, the contract is concluded at the time the credit card is charged.
If you have chosen the PayPal payment method, the contract is concluded when you confirm the payment order to PayPal.
The execution of the order and the sending of all the details necessitated by the conclusion of the contract take place via e-mail, in a partially-automated manner. Consequently, you have to ensure that the e-mail address that you have provided us is the correct one, and that the receipt of the respective e-mails is guaranteed. In particular, you have to ensure that the respective e-mails are not blocked by a SPAM filter.
The contract is concluded exclusively in German.
You can correct input errors before submitting your order using the technical means provided in the online shop and the usual functions of your keyboard / mouse. You can also cancel the process at any time by closing the browser window. By clicking the “Place Order” button you have placed a binding order (offer); Input errors can then no longer be corrected.
- DELIVERY / PRICES / SHIPPING COSTS
All prices indicated on the seller’s website are inclusive of statutory value-added tax (VAT) at the valid rate. The vendor charges delivery costs in addition to the prices indicated. Delivery costs are clearly explained to the customer on a separate webpage and during the order process itself.
We deliver within the Federal Republic of Germany and the countries listed in our Shipping & Delivery page. The delivery takes place within 3-5 days from the receipt of your order, unless otherwise agreed or a different delivery time is specified in the item description.
All prices are total prices in euros, ie they include all price components and the statutory sales tax.
In addition to the prices indicated, we charge for shipping costs for each order as specified in our Shipping & Delivery page.
When shipping to non-EU countries (e.g. Switzerland), the recipient may incur customs fees. Please inform yourself about this at your responsible customs authority.
Shipping costs are charged at a flat rate of EUR 4.99 (Germany) and are exclusive of statutory value-added tax (VAT).
3.1 Payment terms
We offer you the following payment types. Simply browse the list for the best payment type for you. Shipping costs may vary depending on the payment type selected. The prices given in the respective offers are final and include all price components (including any applicable tax such as value-added tax (VAT)). Other taxes (e.g. those applicable to intra-Community purchases) and/or duties (e.g. customs duty) are only incurred in connection with cross-border transactions and are payable to the respective customs and/or tax authorities and not the seller. The costs of shipping and delivery are not included in the purchase price and can be viewed on the “Shipping costs” page. They are indicated separately during the order process and to be paid by you in addition to the purchase price.

Your credit card is charged when the ordered goods are dispatched.
PayPal
You pay directly via your PayPal account. After submitting your order you will be forwarded to PayPal. You have to log in there and release the payment there. The charge is made immediately after placing the order.
3.2 Delivery
Unless we have clearly stated otherwise in the product description, all articles we offer are ready for dispatch immediately. The dispatch takes place daily from Monday to Friday. No goods are dispatched on Saturdays, Sundays and public holidays. Delivery with DHL usually takes place within one to three working days, for orders with express shipping via DHL Express, delivery takes place on the following working day if the order is received by 11 a.m. (no delivery on Saturdays).
In the case of payment in advance, the delivery period begins on the day after the payment order is sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the period ends on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.
The seller reserves the right to withdraw from the contract in the event of incorrect or improper delivery by suppliers. This only applies in the event that the non-delivery is not the responsibility of the seller and the seller has, with due care, concluded a specific cover transaction with the supplier. The seller will make every reasonable effort to procure the goods. In the event of unavailability or only partial availability of the goods, the customer will be informed immediately and the consideration will be refunded immediately.
The seller is entitled to withdraw from the contract if, at the fault of the customer, delivery of the goods fails despite three delivery attempts. Any payments already made by the customer will be refunded without delay. The vendor reserves the right to charge the customer the shipping costs occurred.
The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer only when the item is handed over to the buyer.
Customers are notified of delivery periods and restrictions on delivery (e.g. delivery to specific countries to the exclusion of others) on a separate webpage or in the respective product description.
4. RETENTION OF TITLE
The goods delivered remain the property of Dokudu UG until full payment has been made.
5. INFORMATION ON LIABILITY FOR DEFECTS (WARRANTY)

As a consumer, you are requested to promptly check the product for completeness, visible defects and transport damage as soon as it is delivered, and promptly disclose your complaints to us and the shipping company in writing. Even if you do not comply with this request, it shall have no effect on your legal warranty claims.
- REVOCATION RIGHT FOR CONSUMERS
(A “consumer” is any natural person who concludes a legal transaction which, to an overwhelming extent, cannot be attributed to either his commercial or independent professional activities.)
You have the right to revoke this contract within fourteen days without specifying any reasons.

7. TRANSPORT DAMAGEIf goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and please contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or transport insurance.
- LIABILITY
Claims by the customer for damages are excluded. This does not include claims for damages by the customer from injury to life, limb, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by the provider, his legal representatives or vicarious agents . Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.
In the event of a breach of essential contractual obligations, the provider is only liable for the contractually typical, foreseeable damage if this was simply caused by negligence, unless the customer is entitled to compensation for damage to life, limb or health.
The restrictions of paragraphs 1 and 2 also apply in favor of the legal representatives and vicarious agents of the provider if claims are asserted directly against them.
The provisions of the German Product Liability Act remain unaffected.
All instructions on the labels, product instructions, inserts and other product information must be observed. No liability is accepted for any other application and / or handling.
9. APPLICABLE LAW
The law of the Federal Republic of Germany applies, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG). However, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the customer is habitually resident.
If you are not a consumer, but a businessman, a legal entity under public law or an institutional fund governed by public law, our place of business is the place of jurisdiction as well as the place of fulfilment for all services that follow from the business relationships that exist with us. The same condition applies to situations in which you are not associated with a general place of jurisdiction in Germany or the EU, as well as situations in which the place of residence or the usual place of residence is not known at the time of commencement of proceedings. This has no bearing on the capacity to call upon the court associated with another place of jurisdiction.
10. COMPLAINTS / DISPUTE RESOLUTION
Settlement According to EU Regulation No. 524/2013 and based on EU Directive 2013/11, we as an online provider are obliged to inform our customers of the online dispute settlement platform (OS) of the European Commission. The OS platform can be reached via the following Internet address: https://ec.europa.eu/consumers/odr/. With this platform, consumers have the opportunity to settle any disputes online and out of court that arise from the online sales contract between them and our company. 11. STORAGE OF CONTRACT TEXT
The complete text of the contract is not saved with us. It will be sent to you immediately after submitting your offer to conclude a purchase contract together with the terms and conditions by email. If you have registered for the customer account in the online shop before completing the shopping cart process, you can also call up the contract text via your customer account (“your account”) after entering your access data. You can also print out the offer data immediately after submitting the order.

- SEVERABILITY
The contract remains binding in its remaining parts even if individual points are legally ineffective. If applicable, the statutory provisions replace the ineffective points.
